The Argentine Supreme Court has refused to enforce a US$9.5 billion judgment against Chevron over environmental pollution in the Amazon that an UNCITRAL tribunal has found to be a denial of justice.
On 30 July, a five-strong bench of the court unanimously ruled that the extraordinary appeal by the members of an indigenous Ecuadorean community – who sought to overturn an earlier decision to decline jurisdiction over their enforcement bid – was inadmissible.
The Ecuadorian plaintiffs were represented in the Argentine courts by Buenos Aires firm ABFA Abogados. Chevron used Martínez de Hoz & Rueda Abogados, Estudio Arslanian & Asociados and Emilio Cárdenas, the former president of the International Bar Association, along with in-house counsel.
